BALCA Decision
Common Law Wife
Seeks to Continue LC
Joram Rosenfield, 99-INA-158 (BALCA, January 6, 2000)
Employers common law wife attempted to continue with the application for a live-in cook to work in the household after the death of her husband. The Board ruled that the application was filed by an individual and not by a corporation. A personal application...does not survive the death [of the employer], wrote the Board. The Board noted that the request, while reasonable under the circumstances, was not permissible under the Act and regulations. The Board invited the common law wife to file a new LC application. (Denied, Region II).
