when my company applied for my F1-H1b visa, they did not apply my wife's F2-H4 visa as a result of which her status became invalid as soon as I got my H1b approved. Out of ignorance I did not apply for her I-539 until after 4 months of my H1b approval. Ultimately I applied her I-539 and got her status re-instated recently. My question is now:
can she get her H4 visa stamped in Mexico or do I have to take her to India to get the stamp. I have heard that if one person falls out of status, then even after reinstatement of status, consulates in Mexico and Canada are strict in NOT giving H4 visa stamp...
Any gurus!!! please advise, I have to go to India and I fear american consulate in India would give us a hard time, since she fell out of status in the past....
