PLAINTIFFS URGENTLY NEEDED FOR CLASS ACTION CHALLENGING RETROACTIVE APPLICATION OF INA ' 241(a)(5), REINSTATEMENT OF PRIOR ORDERS OF DEPORTATION.

We are seeking plaintiffs for a potential class action lawsuit in the U.S. District Court, Northern District of California. The lawsuit challenges retroactive application of INA ' 241(a)(5), summary reinstatement of prior deportation orders.

We need plaintiffs who:

• Were deported or departed voluntarily under an order of deportation prior to April 1, 1997, and
• Have reentered the United States unlawfully either before or after April 1, 1997, and
• Are seeking to adjust status under INA ' 245(i) or NACARA, are applying for suspension or cancellation of removal under NACARA or otherwise, are applying for asylum or withholding, or otherwise risk reinstatement of the prior deportation order under INA ' 241(a)(5). Plaintiff can be applying for relief affirmatively, or defensively in deportation or removal proceedings.
