Affidavit of Support/Humanitarian Reinstatement

The American Immigration Law Foundation (AILF) would like to hear about situations in which the INS denied adjustment of status or the American Consulate refused to issue immigrant visas to beneficiaries of I-130s that were reinstated for humanitarian reasons after the petitioners' death, because these beneficiaries were unable to present I-864 affidavits of support from the dead petitioners.  It seems to be the INS (and perhaps DOS) position that such beneficiaries are inadmissible under INA §212(a)(4)(C) because they cannot present an I-864 from the petitioners.  If you have such a case, please send a brief, one page summary of the case by fax ((202) 371-6459) or e-mail (thong@ailf.org) to Traci Hong at AILF.
