Rosetta Landscape Management, 97-INA-353 (BALCA, September 20, 1999)

The CO asked the employer to provide weekly payroll records for the last three years for all workers in the position of landscape gardener. On rebuttal, the employer presented payroll records for the months of December, January, and February but argued that records for 156 weeks would be too voluminous to reproduce. The board agreed with the employer and held that the winter payroll records were sufficient to establish the year-round nature of the job. (Granted, Region III).
