[Note:The U.S. INS is required to record for reporting purposes four items of information associated with any H-1B petition (the beneficiary's educational degree level, the primary/major field of study, the total compensation offered the beneficiary, and the 3-digit LCA code). The INS has developed an internal Form G-1020 for this purpose. The INS welcomes completed G-1020s with any I-129 submitted for H-1B classification (though the G-1020 is not a required document). If, in H-1B extension cases, the U.S. INS cannot determine the beneficiary's educational level or field of study, the U.S. INS will retrieve the file containing the original H-1B petition in order to find this information; the U.S. INS will not issue an RFE just so that it can meet its new data collection obligation.]

Instruction for Form G-1020, Specialty Occupation Data Collection

1. The "Address Label" and "Receipt Label" box are optional. However, for accuracy, it is recommended that you use the receipt label provided with the petitions and attach it to the "Receipt Label" box.

2. Question number one asks for the beneficiary’s highest degree earned and provides a box next to the letter from "a" through "i".

Place a check or "x" in the appropriate box that is most closely related to the degree submitted with the petition.

3. Question number two asks for the beneficiary’s major or primary field of study and provides thirty boxes (30 characters) in which to write. This is because CLAIMS will only allow for thirty characters.

Uses the submitted transcript to determine the beneficiary’s minor and major. Once you determine the beneficiary’s major or primary field of study, fill in the boxes with one character per box.

4. Question number three asks for the beneficiary’s rate of pay per year.

The rate of pay is the total compensation of the beneficiary’s annual salary and benefits (i.e. housing, medical, annual/sick leave, etc.), therefore, if the Adjudicating Officer determines that the petition requires additional information, the Officer may want to ask for the "Total compensation."

5. Question number four ask for the LCA Code.

The LCA Code is a 3-digits code that can be obtain from the Labor Condition Application (LCA) Form 9035.

Service Centers’ Directors are required to develop procedure to ensure that all Form G-1020s are completed accurately. This verification needs to be done at least once a month.
