EOIR Confirms Deadline for Supplementing NACARA Motions to Reopen
Certain Aliens Who Have Filed NACARA Motions to Reopen with EOIR Must Complete and Submit Their Accompanying Applications for Suspension/Cancellation by Nov. 18, 1999
On July 26, the Department of Justice published a notice in the Federal Register alerting certain aliens who filed an abbreviated motion to reopen their cases in order to seek relief under Section 203 of the Nicaraguan Adjustment and Central American Relief Act of 1997 (NACARA) that the deadline to complete and submit the accompanying application and supporting documentation for suspension of deportation or cancellation of removal is approaching. Final submission of applications and supporting documentation on the abbreviated motion to reopen is due no later than 150 days after the effective date of the interim rule implementing Section 203. The effective date of that rule was June21, 1999. Accordingly, the deadline to complete a NACARA motion to reopen is November 18, 1999.
This means that certain nationals of El Salvador, Guatemala, and certain former Soviet bloc countries WHO TIMELY FILED AN ABBREVIATED MOTION TO REOPEN by September 11, 1998, with the Immigration Court must submit all additional documents and the application for cancellation or suspension on or before November 18, 1999, in order to be considered for relief under NACARA.

actual date of November 18, 1999, but a correction was published
on August 3 (64 FR 42146) to clarify the actual date.]
