Introduction
- On January 9, 1983, the Executive Office
for Immigration Review (EOIR) was created through an
internal Department
of Justice (DOJ) reorganization
which combined the Immigration Judge function previously
performed by employees of the Immigration and Naturalization Service (INS) with the Board of Immigration Appeals (BIA).
Originally, EOIR included the Office of the Director,
BIA, which heard appeals to immigration decisions, and
the Office of the Chief Immigration Judge (OCIJ), which
supervised the performance of the Immigration Judges
located in courts throughout the nation. In March 1987,
the Office of the Chief Administrative Hearing Officer
(OCAHO) was established as an additional unit within
EOIR. OCAHO is responsible for administering the hearing
process issues arising under the employer sanctions,
document fraud, and antidiscrimination provisions of the
Immigration Reform and Control Act of 1986 (IRCA) and the
Immigration Act of 1990 (IMMACT). EOIR is completely
independent of both the INS, the organization charged
with the enforcement of the immigration laws, and the Office of Special Counsel for Immigration
Related Unfair Employment Practices, the entity charged with the enforcement of the
antidiscrimination provisions of IRCA.
